Why state laws matter

The United States faces an unprecedented epidemic of prescription drug overdose deaths. States carry most of the responsibility for regulating and enforcing prescription drug practices, and state laws have proven benefits in preventing many kinds of injury — yet little is known about how well state statutes and regulations against prescription drug abuse and diversion work.

With CDC's National Center for Injury Prevention and Control, the Public Health Law Program created "menus" summarizing legal strategies states have used against prescription drug misuse, abuse and overdose, for public health practitioners and their legal counsel.

The menus

MenuWhat it covers
Time and dosage limit lawslimits on prescribing or dispensing controlled substances
Physical examination requirementslaws requiring a practitioner to examine patients before prescribing or dispensing controlled substances
Doctor shopping lawslaws on doctor shopping — visiting several practitioners to get controlled substances without each prescriber knowing of the others' prescriptions
Tamper-resistant prescription formsrequirements for tamper-resistant forms, to curb diversion
Prescription drug identification lawslaws requiring patients to show identification to pharmacists
Pain management clinic regulationhow states regulate pain management clinics
Overdose emergency lawslaws giving 911 callers who respond to an overdose immunity from prosecution or mitigation at sentencing
Pseudoephedrinefederal, state and local efforts to limit access to pseudoephedrine, the main ingredient used to make methamphetamine
